General Rental Terms & Conditions

1. Scope of Application
These General Rental Terms & Conditions apply to all rental agreements for sports equipment between CPS Handels GmbH, Schattau 90, 5442 Russbach, Austria (hereinafter referred to as the "Lessor") and the respective renter.
By making a reservation or collecting the rental equipment, the renter acknowledges and accepts these terms as binding.

2. Reservation and Conclusion of Contract
A reservation becomes valid upon receipt of the reservation request by the Lessor or upon receipt of a booking confirmation.
The rental agreement is concluded between the customer making the reservation and CPS Handels GmbH.
The Lessor reserves the right to reject reservations without stating a reason.

3. Rental Price and Payment Terms
Unless otherwise agreed, the rental fee must be paid directly at the rental shop upon collection of the equipment.
Prices are based on the current price list.
For rentals collected after 3:00 p.m., the rental period will be charged starting from the following calendar day.
For returns made before 9:00 a.m., the current calendar day will not be charged.

4. Proof of Identity
At the start of the rental period, the renter must present a valid government-issued photo ID (passport or driver's licence).
The renter agrees that, where legally permitted, a copy of the ID document may be made and stored for the purpose of securing the rental agreement.

5. Condition and Acceptance of Rental Equipment
By accepting the rental equipment, the renter confirms that it is in proper working condition.
Any defects or issues must be reported immediately upon collection.

6. Duty of Care and Renter's Liability
The renter is fully responsible for the rented sports equipment throughout the entire rental period.
The equipment may not be transferred or lent to third parties.
The renter undertakes to use the rental equipment properly and to take appropriate care of it at all times.
The renter is liable for any damage, loss, or theft occurring during the rental period, unless caused by normal wear and tear.
Improper use (e.g. skiing on gravel-covered roads) entitles the Lessor to charge the renter for any repair or replacement costs.

7. Theft and Loss
In the event of theft, the renter must report the incident to the competent authorities within 24 hours.
A copy of the police report must be provided to the Lessor.
If no insurance has been taken out, the following fixed charges will apply:
Premium Category: EUR 350.00
Sport Category: EUR 250.00
Top Category: EUR 150.00
The Lessor reserves the right to claim compensation for any actual damage exceeding these fixed amounts.

8. Rental Insurance
The rental equipment is not insured by default.
For an additional fee of 10% of the rental price, insurance against damage and theft may be purchased.
The insurance does not cover damage caused by gross negligence or improper use.

9. Bindungseinstellung bei Ski
Skibindungen werden auf Grundlage der vom Mieter gemachten Angaben (insbesondere Gewicht, Größe, Alter, Fahrkönnen) nach geltenden Normen eingestellt.
Der Mieter bestätigt die Richtigkeit seiner Angaben.
Eine eigenmächtige Veränderung der Bindungseinstellung ist unzulässig und erfolgt auf eigene Gefahr.

10. Exchange of Rental Equipment
The rented sports equipment may be exchanged during the rental period.
If the renter upgrades to a higher equipment category, the applicable surcharge according to the current price list must be paid.

11. Return of Rental Equipment
The rental equipment must be returned at the agreed time.
If the equipment is returned late, the rental fee will be charged for the additional rental period.
If the equipment is not returned without a valid reason, the Lessor reserves the right to report the matter to the authorities on suspicion of unlawful appropriation.

12. Safekeeping of Rental Equipment
The renter must store the rented sports equipment in a manner that prevents theft or accidental mix-ups.
Skis should be stored separately from one another or secured in ski lockers.
Overnight, the equipment must be kept in a locked room or in a locked vehicle.

13. Non-Use / Weather Conditions
No refund will be granted if the rented sports equipment is not used due to unfavorable weather conditions.
If the equipment cannot be used due to illness or injury, the rental fee for the remaining rental period will be refunded upon presentation of a valid medical certificate.
In the event of a complete closure of the Dachstein West ski area, the remaining rental days will be refunded upon presentation of a confirmation issued by the lift operator.

14. Lessor's Liability
The use of the rental equipment is at the renter's own risk.
The Lessor shall only be liable for damages resulting from intentional misconduct or gross negligence.
Liability for personal injury remains unaffected.

15. Data Protection
Personal data is processed in accordance with the applicable national and European data protection laws.
Data is processed solely for the purpose of fulfilling the rental agreement and handling reservations.
Personal data will only be disclosed to third parties where required by law or necessary for the performance of the contract.

16. Governing Law and Jurisdiction
These Terms & Conditions shall be governed exclusively by the laws of Austria, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).
The Lessor is entitled to bring legal proceedings against the renter at the renter's place of residence or before any other court having statutory jurisdiction.
For consumers, the mandatory jurisdiction provisions of the Austrian Consumer Protection Act shall apply.
